These General Terms of Sale are entered into between:
On the one hand, IBRACI LINKS SAS, a simplified joint-stock company with capital of 1,000,000 CFA francs, registered with the Bamako Trade and Personal Property Credit Register under number MA.BKO.2022.B.927, with its registered office at Faladié, en face de SONEF Transport, Bamako - Mali.
And on the other hand, any legal entity or natural person, hereinafter referred to as the Client, whether public or private, committing to one or more services provided by IBRACI LINKS.
These General Terms of Sale govern the framework under which IBRACI LINKS provides the Client with the service(s) to which the Client has subscribed.
The Client’s subscription to one or more offers provided by IBRACI LINKS implies that the Client fully understands these General Terms of Sale.
These General Terms of Sale and any applicable Special Conditions are governed by Malian law.
IBRACI LINKS is bound by an obligation of means under these terms. In this context, IBRACI LINKS will use all reasonable diligence to provide a quality service.
IBRACI LINKS cannot be held liable for compensation for direct and/or indirect damages suffered by the Client, especially due to the performance or improper performance of the service(s).
The Client undertakes to comply, in the content distributed via the service(s) provided by IBRACI LINKS, with the legal and regulatory requirements in force.
Any activity carried out by the Client through the service(s) provided by IBRACI LINKS that could give rise to liability for IBRACI LINKS is prohibited.
The Client’s service(s) may be suspended immediately by IBRACI LINKS without prior notice, formal notice or prejudice if IBRACI LINKS receives a notice to this effect from a competent authority or in the event of blatant abuse (SPAM, PHISHING, etc.).
IBRACI LINKS provides a web hosting service, not a storage service. Use for archiving, backup, storage or any similar activity is not permitted on our servers. The resources made available (disk space, CPU, RAM, bandwidth) must be used legitimately and reasonably.
On Cloud servers, any illegal or suspicious activity (intrusion, hacking, sniffing, spoofing, proxy, etc.) is prohibited. Support for these offers is limited to network and hardware issues.
A monthly availability rate of 99% is guaranteed for our hosting offers. If availability falls below 99%, IBRACI LINKS undertakes to compensate the client by offering 1 free month. This request must be made within 30 days following the end of the month concerned.
Any event that is unforeseeable, external to either party and irresistible is considered force majeure and, as such, suspends the obligations under these General Terms of Sale and releases IBRACI LINKS from any liability.
The following events are considered force majeure, without this list being exhaustive: natural and industrial disasters, strikes, civil or foreign wars, terrorist attacks, riots, popular uprisings, hardware failure or failure of one or more communication networks.
Backups must be made regularly by the client. IBRACI LINKS cannot be held responsible in the event of data loss (hard disk failure or otherwise).
IBRACI LINKS grants the Client a withdrawal period of ten (10) calendar days after payment of the order without needing to state a reason. This right applies to all products except registered domain names and activated SSL certificates. No refunds are made on renewals, regardless of the product.
The total amount payable is shown on the invoice created for each order or service renewal in the Client’s administration area on IBRACI LINKS’s website. This amount is payable in CFA francs.
IBRACI LINKS reserves the right to modify service prices at any time.
Before the expiration of the Client’s service, IBRACI LINKS informs the client 21 (twenty-one) days in advance by email sent to the contact address listed on the client account. In addition, the expiration date of the Client’s service is shown in the client area.
The Client may renew their service(s) before expiration at the price in force on the day of renewal. Renewal is possible up to 20 days after the expiration date of the web hosting service and 20 days after the expiration date of the domain name. After this period, IBRACI LINKS cannot guarantee continuity of the subscribed service.
Generating an invoice does not oblige the client to pay it. To cancel a product, the client may simply not pay the corresponding invoice. The client may also request cancellation of their service at any time by online ticket or by mail.
The Client appoints IBRACI LINKS as an authorized intermediary to change information related to a domain name on the Client’s behalf.
The referral program is the tool allowing the Client to earn a commission on each product ordered by a customer (“the Referral”) who used the Client’s unique link. The Client can find this link and the details of the referral program in the client area. The commission will only be validly paid to the Client if the Referral is a third party to the Client, and IBRACI LINKS reserves the right to refuse payment in the event of a fraudulent transaction or a refunded transaction. In case of doubt, IBRACI LINKS may request proof of identity from both the Referral and the Client before processing the commission payment. IBRACI LINKS also reserves the right to suspend the Client’s participation in the referral program in the event of a breach of the conditions above. In that case, the client may recover any remaining commissions if they exceed the minimum withdrawal amount.
If your hosting account is not renewed for 21 days or more, we may terminate it. Once your account is terminated, you acknowledge and accept that we may permanently delete your hosting account and all data associated with it, including your websites.
The Client and IBRACI LINKS expressly agree that IBRACI LINKS may amend its General Terms of Sale at any time on its website https://ibracilinks.com/.
Any breach of these General Terms of Sale may result in the immediate suspension of the Client’s service(s) by IBRACI LINKS, without prior notice, formal notice or prejudice.
